How to use the property tax decision desk

  1. Select the tax question. Choose selling, home loan, rental income or buyer TDS. These are separate planning calculations, not a whole-income tax return.
  2. Enter evidence-based inputs. Use the applicable sale value, actual cost and dates. Enter an official CII-derived index multiplier only for eligible pre-23 July 2024 land or building.
  3. Check relief eligibility. Choose the residential-house or other-asset reinvestment route. Enter only qualifying investment, verify caps, deadlines and ownership conditions, and do not allocate the same gain twice.
  4. Compare and review. Read explicit best, likely and worst assumptions. Download a free PDF and take it to a CA before payment or filing.

What questions does the Tax Calculator answer?

What is the stamp duty on property in India?

It depends on state, local jurisdiction, valuation band and eligible ownership concessions. Use /tools/stamp-duty for the sourced, indicative schedule covering 28 states and 8 union territories. Unverified rates are not substituted.

Do I have to pay TDS when buying property?

For a resident seller with valid PAN, the ordinary property-purchase rule is 1% of the higher consideration or stamp-duty value when either reaches ₹50 lakh. Consider aggregate transaction value, not each co-owner’s share. Agricultural-land exclusions, missing PAN and non-resident sellers need separate checks. Use current department forms and deadlines under the 2025 Act; old section 194-IA is a historical 1961 Act reference.

How is LTCG on property calculated post-2024?

Long-term land or building generally requires holding for more than 24 months and uses 12.5% without indexation. Resident individuals/HUFs with qualifying property acquired before 23 July 2024 have a tax safeguard comparing 20% indexed tax. Section 197 of the Income-tax Act, 2025 preserves this comparison. Estimates include 4% cess but exclude surcharge and whole-return adjustments. Indicative · Oct 2026.

How can I save LTCG tax on property sale?

Subject to eligibility, residential-house reinvestment and specified bonds can provide relief. The familiar old sections 54, 54F and 54EC are under the Income-tax Act, 1961 and are renumbered in the 2025 Act. House investment has a ₹10 crore ceiling; specified bonds have a ₹50 lakh cap and six-month investment deadline. House purchase/construction, ownership and CGAS conditions must be checked. Do not allocate the same gain twice. Indicative · Oct 2026.

Is GST applicable on property purchase?

Ordinary under-construction residential apartments generally attract 5% GST, or 1% for qualifying affordable housing with a price not exceeding ₹45 lakh and applicable carpet-area and project conditions. Completed-property sales after completion certificate or first occupation, as applicable, and ordinary resales generally do not attract GST on the property sale. See the Stamp Duty workbench. Indicative · Oct 2026.

How is municipal property tax calculated?

Local authorities use different valuation methods and exemptions. This workbench does not calculate municipal property-tax bills. Use your municipality’s current assessment and payment portal.

Are joint owners taxed separately?

Tax treatment depends on legally ascertainable ownership shares, actual funding, repayment, eligibility and possible clubbing rules. Joint ownership alone does not create automatic capital-gains exemptions or home-loan deductions for every owner. Ask a CA to allocate the amounts correctly.

Is gift of property to family taxable?

Receipt from a relative as legally defined may be exempt, but “family” is not a universal exemption. Non-relative property gifts have separate stamp-value tests and exceptions; later sale may inherit the donor’s cost and holding history. State gift-deed duty can still apply. Obtain advice before executing a deed.

Which law and section references does this calculator use?

Labels marked “old s.” refer to the Income-tax Act, 1961, renumbered by the Income-tax Act, 2025 from 1 April 2026. Verified 2025 Act mapping: house interest 22; house reinvestment 82 (old 54); bonds 85 (old 54EC); other-asset house relief 86 (old 54F); principal/savings ceiling 123 (old 80C); LTCG 197; new regime 202; resident property-purchase TDS 393(1), Table 3(i) (old 194-IA). Check current department filing forms and deadlines separately.

Who has indexation protection?

Resident individuals and HUFs selling long-term land or buildings acquired before 23 July 2024 can compare 12.5% without indexation with 20% indexed tax. Section 197 of the Income-tax Act, 2025 preserves this protection. Holding must exceed 24 months. Basic-exemption adjustment, surcharge and losses are not modelled.

How do the house reinvestment routes differ?

Old section 54 (2025 Act section 82) concerns long-term residential houses; relief is limited to qualifying gain and eligible house investment, with a ₹10 crore investment cap. Old section 54F (2025 Act section 86) concerns other long-term assets for an individual/HUF: relief is proportional to eligible house investment divided by net consideration, capped at the gain and subject to the ₹10 crore investment limit and other-house ownership restrictions. Visit PropyMart for full details.

What is the bond exemption limit?

Old section 54EC (2025 Act section 85) covers qualifying long-term land/building gains invested in specified bonds within six months. The ₹50 lakh investment cap applies across the relevant financial years, with a five-year lock-in. Do not use the same gain twice.

Are home-loan deductions tax refunds?

No. For eligible self-occupied acquisition/construction loans, old-regime interest deduction is up to ₹2 lakh under old section 24(b), with completion and other conditions. Eligible principal uses remaining room within old section 80C’s combined ₹1.5 lakh ceiling. Neither is modelled for self-occupied homes in the new regime. Compare your complete return, not deductions alone.
